iPod Touch freezes A LOT

I got my touch in sept when it came out, until about 3-4 weeks ago it has be causing SO SO much trouble!!

About my ipod:
* Had software upgrade
* Bought from apple online store
* NEVER did anything like this before

1) it would ALWAYS freeze when:
* I press press home after i move icons
* It will freeze when i press home from mail, internet and photos

2) (note: Battery would be FULLY charged) i would restart it and it would not turn back on, i would leave it for TWO days and only AFTER 2 days would it turn on to the DEAD battery screen then i have to wait for it charge!

3) from the ipod i erased everything and then i plugged it into my ipod and even while it was plugged in it froze.

4) Now what REALLY * me off is that it will freeze all the time and then it wont freeze at all. back and forth!!

I am at my wit's end!!! Please help! in any way you can!
Should i send it into apple??

i would say send it to the apple :] They will fix everything.. Also, apple has replacement places in some store locationsn which you could get a ipod touch right away! Check out the apple website.

Is it still under warranty? If so no question bring / send it in.

The freezing has actually been happening to mine a lot too. And also I'll be listening to a song and it will just cut off and go to the home screen. Perhaps I should get it taken care of. It's a cool ipod, but the problems are bad.

Is it jailbroken?
My iPhone crashed a lot when it was jailbroken, just back it up and restore.

if its an iTouch it will definitely be covered under warranty. go into the apple store (i think you can do it online aswell) and they will pick it up for free, but bear in mind that you (or someone else) needs to be at home all day to wait for the courier.
my touch does freeze when i go on HUGE webpages in safari, but thats about it.
