    IN the last week, the Supreme Court made 7 new states pass the marriage equality law. And now, North Carolina is suing the Supreme Court

    It's impossible to sue the Supreme Court of the United States, because although it is possible to name all of the justices as defendants, there is arguably no court in which the case could be heard. Finally, the appeal possibilities would look quite odd, because the President would have to nominate temporary Supreme Court justices to hear the final appeal. We don't have a constitutional process for that.

    That's ridiculous. They can't *sue* the Supreme Court. If they say that's how it is, that's how it is!


    Anyway, I'm glad that seven states are going to get it. Might I ask what the other six are?

    One cannot sue the Supreme Court.

    The only way to sue the Supreme Court, per se, would be to bring articles of impeachment against the justice(s). It would be funny if the Chief Justice get sued and he presides over his own impeachment LOL.

    The Supreme Court decided they would not hear the cases trying to ban same-sex marriage or reverse the rulings that made them legal. As such, many states stopped fighting because if SCOTUS refuses to hear them, there's nothing further they can do. By denying to hear them, SCOTUS is essentially saying that the opposition has no grounds to stand on, and as such, the states are falling like dominoes.

    Then there's some states, including North Carolina, that are trying to fight the court rulings that legalized Same-Sex Marriage, citing that their state constitution still prohibits them.

    However, it's a losing battle. A court ruling has already been made. They can continue to try to get SCOTUS to hear it, but eventually they will give up. A federal court made a ruling that encompasses multiple states. It doesn't matter if their state constitution prohibits it. A federal law/ruling supersedes a state one. At one point, it's going to reach the point that the basic courts won't even allow them to fight.

    No one is suing SCOTUS. That's not possible. They're simply pushing to get them to hear it next time.

    I'm sure the longest tenured associate justice would be in charge of the trial.

    No, I think what would have to happen is that there would have to be a special session of Congress to create an emergency judicial panel. We don't have a constitutional process for naming the entire Court as defendants. (Of course, we don't have a constitutional process for emergency judicial panels with appellate jurisdiction either, but whatever.)

    But in the revolution, we won't have such problems.

    Seeing as Puerto Rico is the only likely US controlled territory that could be a state in the near future, and that the US Mariana and other islands don't have near enough people to for one state, let alone multiple ones, it would be a bit difficult to get 7 States. But I digress, it would be very interesting if we admitted seven new States.

    Well, Texas could try to invoke the clause of the Joint Resolution of Annexation that was signed in 1845 and gave Texas the right to have up to four new states emanate from its land (a provision placed for a time where free states and slave states teeter tottered for control)

    So, we could have the State of Texas and four more states. There you go, four new states :lol:.

    Not that it's gonna fly :badgrin:.

    What are you talking about? NC overturned its ban and same sex marriage is legal here. There was no confrontation at all; it's done. They even had gender-neutral forms ready to go today and they started issuing marriage licenses last Friday.

    For all that said citation needed look it up. I dont what the grounds were or how exactly they did it. they may have just sued the government.
