Yes, its the thing that no one wants to admit too, being harassed. And I am now admitting it... At work there is a bully that keeps calling me gay and saying I only like boys not girls and saying me and my best friend always have sex with each other.

And I'm pissed off with it and want it to stop. I've told the Store Manager (she has since quit) and I have told the District Manager. He has had a talk to him and the witness to one incident yet nothing but more harassment has happened. The harasser continually goes on about how I dobbed on him and he gloats about how he lied and got away with it. Tomorrow I am going to tell another manager what happened tonight, he said that I have sex with my friend... I hope she does something because i want it to stop NOW. or else im quitting and finding a new job.

I have been writing little notes about what hes been doing and saying which is what my former Store Manager told me to do. And its quite a nice story as well. If this continues and they don't do anything should I sue the store? Because they are letting the harasser continually harass me and make it worse by just keeping him there even after I've shown evidence that hes doing it...

Last night I worked from 5:30PM till 12:00AM and I start this morning at 5:00AM. Its a mere 3 hours away but I can't get any sleep because I got all this shit in my mind to think about.

I'm just so sick of it all. :frowning2:

That really sucks. I think you should talk to a lawyer if the company does nothing, but I am not positive if you could sue for that

I think u shud make a law suit if uve tried everything go to court and file a demand give the bastard what he dserves. here in the US job harrasment isnt taken very lightly. Where my mom works her boss' sister went to work and some clothes issue of how she was dressed and i think she was fired. And more drama! haha

Can you get a recording of what he's saying somehow? That could give you more evidence when you speak to your manager next, which could help if he/she doesn't fully believe you.

Also do you have a colleague who has witnessed it, who could also speak to the manager about it. Reports from a third party (especially someone who is older and has been there for a while) can often have more impact.

If none of that or the advise above helps, then it may be easiest to look for another job. OK, it means the bully has won, but so what. You don't need this level of hassle and distress at work, and would be better out of it. If the management don't take things like this seriously, it's not a good place to work anyway.

Thanks everyone for your concern. I still can't get to sleep..

Yeah I have witnesses Paul, the District manager spoke to the witness and he said to him that it's all true. I will get my manager tomorrow to talk to a crew member that was on last night for more evidence.

I would quit but sadly I need money.

If the person admitted that they do this to the district manager, and that person hasn't been fired as a result, then there's something wrong. Go over the district manager's head if necessary. Send a note to the company president. This is not something they'd want to have continue if they knew it was happening.

I didn't suggest you just quit. Look for another job, then quit.

I don't know what type of store you work in or whether it is specialist stuff you do, but if it's a fairly general store and you are in a reasonable sized town there should be other stores looking for staff. So you can take the skills and experience with you, which should make you a more attractive candidate than someone who hasn't done store work before.

Hopefully it won't come to that though. It sounds like you have the evidence and witnesses to back you. As Jim said, if the manager won't help go to the district manager. If he won't help then go above him. If it is a larger chain they probably have a company grievance procedure that you can find out about from your manager or through head office.

Sometimes asking the manager who won't help about the grievance procedure and how to take your complaint higher can spur them into doing something. Managers do not like their deficiencies highlighted to their superiors!

EDIT - I have done exactly that today, with a site manager here on the new housing development where I live who was coming up with some fairly unbelievable explanations and excuses regarding a badly designed footpath layout by our house. I asked him for the name and address of someone in head office to complain to, since it was obviously something he couldn't deal with. I don't have the name and address, but I have been reliably informed that the matter is being discussed in a meeting which this person and his managers are attending this afternoon....

My manager called a few people today and I do have another witness. Shes going to have a talk to the district manager about it and she thinks he could get fired, but he also may not. (3 tries I think is too much)

Call the ACLU, they usually scare things like this away.

*hugs Jayden* we don't need them kind of people, they can SUCK IT *cue DX music* ^_^

I don't think the district manager is going to do anything. o_o (by anything I mean remove the harasser from the workplace -.-) i gave him my letter which says all the stuff thats happened, all the times I've told ect. But he never said what hes going to do...

If he doesn't get fired is that when I take legal action?

Rather than considering legal action now, if the district manager won't do anything (give him a week or two - it won't be instant) then you need to take it further up the chain.

Phone head office and ask the receptionist the name of the person above the district manager and the address to write to for his office.

Or ask to speak to HR (Human Resources) and find out what the company grievance procedure is. You could explain that you have already gone to the district manager with no success and ask what you should do next. If it cannot be sorted out within the company, there may be an independent arbitration service that you can use (which would be a part of the grievance procedure) that would be free or cheaper than employing a lawyer.

    Lots of info there.

Tom I know exactly how you feel. I get harassed nearly identical day in day out and nothing happens about it. *hugs* Remember that you are not alone in this. Getting yourself psyched up can be the worst possible thing for yourself right now.

For getting to sleep, have you tried doing any breathing exercises? If you need some just drop me a line on MSN. I try a couple when I can't sleep and they work perfectly for me.
And of course after this is all settled you'll find your health and sleep patterns get better.
