LGBT News Pennsylvania reportedly won’t defend gay marriage ban in court

    Interesting.

    But what will this mean?

    Could PA become the next state to have legal same-sex marriage this easily?

    If PA goes, then all we need is New Jersey, to have all the states along the east coast, from Maryland to Maine.

    So it appears that the Governor of PA will fight to keep gay marriage illegal there, even if the attorney general won't.

    Curious as to how this case will turn out, if there will be m(any) appeals.

    It also reminds me why I'm a card-carrying member of the ACLU!

    Until just recently, NC was among the most progressive southern states...I think things got bad in the past year, when Republicans took control of everything, but hopefully this will chnage again, soon. I think your state will change sooner than many lot of others.

    Yeah, Tom Corbett isn't a very popular governor right now. He's had to make some tough decisions (thanks to Ed Rendell's reckless spending) and it's still a little early, but I don't see him getting re-elected at this point.

    It seems that the states are afraid to defend these laws in court now(i.e Prop 8 was not defended by CA), which seems like a good sign for it to get legalized in PA.

    does anyone know much about the laws here in Florida and how likley they are to pass it ? i just moved here and dont really now much about it.

    The Attorney General of NC is allowing a lawsuit to proceed against the gay marriage ban in NC. He will still defend the ban, but he's allowing the lawsuit to proceed, which is progress.

    Most states don't ban gay marriage, they just don't do them. There's actually no laws against or for it in many states. However, laws exist in those states that do not recognize same-sex marriages from other states/countries. That's why there haven't been many suits going against states. Because there's nothing to go against in most states. A law has to be passed to allow SSM or disallow for anything to happen. It's a matter of when one of their politicians will attempt to put one on the ballet.

    Not a lawyer so I'm not too knowledgeable when it comes to law, but, sadly, most of our big LGBT organizations are now concentrating on finding a way to get the ban repealed at this point. After it gets repealed then we can work on getting same-sex marriage approved.

    As of yet it seems they are still trying to figure out which way (suing the state, referendum or another one) would be the easiest way to get things going. As we speak I know the Equality Florida is looking for possible plaintiffs that are willing to sue the state.

    Scroll down a ways on this page for another look which includes civil union states although it was from before CA regained equality. New Mexico is interesting in that it has no specific law against equality.

    As for the PA case, I think it's good that a state official is defending the law so that we don't end up with the case not being decided on its merits later due to lack of standing as happened to the Prop 8 case. The state has no valid reason to deny equality as CA didn't in the Prop 8 case; it's indefensible. Each case going forward will use the best evidence supporting equality and showing discrimination for the animus that it has always been. :stuck_out_tongue_closed_eyes:ride:

    I hope this isn't a joke because PA is the Alabama of the NE states. The most I've seen are some protection laws for trans*folk in some cities and counties and that's it. I hope this is the next state to get marriage equality.
