New Mexico has never made any for or against Same-Sex Marriage. Any laws to legalize, recognize, to give civil unions or domestic partnerships have failed, and any laws to prohibit them have also failed. Therefore, there's nothing to go by. It really goes down to the courts in the state by this point.

Same-sex marriage is legal in New Mexico, their government just refuses to enforce the law. The laws regarding marriage in The Land of Enchantment are as follows:

"Marriage is contemplated by the law as a civil contract, for which the consent of the contracting parties, capable in law of contracting, is essential.

All marriages celebrated beyond the limits of this state, which are valid according to the laws of the country wherein they were celebrated or contracted, shall be likewise valid in this state, and shall have the same force as if they had been celebrated in accordance with the laws in force in this state."

Unless New Mexico law states that only a man and a woman can enter into a contract, then gay marriage is legal and should be recognized in New Mexico.
