LGBT News New Mexico legalizes same-sex marriage

    The New Mexico Supreme Court ruled today that under New Mexico law, same-sex marriage is in fact legal, and that even if state law had said that marriage is between a man and a woman, it would still violate the State Constitution.

    New Mexico is now the 17th state to fully legalize same-sex marriage, as over the summer, 8 out of New Mexico's 33 counties, covering 58% of the state's population, had begun issuing marriage licenses to same-sex couples.

    The New Mexico law regarding marriage had stated,

    "Marriage is contemplated by the law as a civil contract, for which the consent of the contracting parties, capable in law of contracting, is essential."

    Gay couples can now marry in the Land of Enchantment immediately, as existing law has now been interpreted. The only way for gay marriage to become illegal in New Mexico would be through a constitutional amendment, and with a Democratic supermajority in both houses of the Legislature, that's not going to happen.

    This is wonderful, and it's good to have some positive news as the year ends, and the Holiday season gets underway.

    I wonder what the next state will be?

    I'm sure by November 2014, Oregon will have legalized same sex marriage. Oregon Says I Do is collecting signatures. They need to collect 116,284 signatures, but they already have 120,161 signatures as of today. It has been a huge success. Within the next hear, I believe Oregon will have passed marriage equality. I know that there are also other states with cases pending. I also think Ohio will legalize same sex marriage very soon. The tide is turning =)

    Wow. I kinda suspected this was going to be the ruling based on how they didn't prevent the counties to continue issuing marriage licenses (which was a big hint). Glad my neighbor state now has marriage equality on the books.

    We've crossed the "1/3 of the states" threshold (34%)!

    This is great! I was actually expecting Michigan, Oregon, or Pennsylvania to legalize it first. Hopefully those states will legalize it before the end of 2014.

    To recap, when I started high school in 2009, 4 states had legal gay marriage. (MA, IA, CT, VT) When my boyfriend and I became a couple in 2011, 6 states plus DC had gay marriage. (MA, IA, CT, VT, NY, NH). When I graduated high school in May, two days before I joined EC, it was up to 13. (MA, IA, CT, VT, NY, NH, WA, ME, MD, RI, DE, MN) and now, with just 12 full days left in the year, we're up to 17 and counting.

    Oregon will be the next to legalize it through the legislative process, and Virginia, Nevada, and Pennsylvania could be next via lawsuits. We could be up to 21 by the end of next year. By 2016, we may see Ohio, Michigan, Colorado, and even Utah with legal gay marriage through a combination of the courts and the ballot boxes.

    The conservatives said we could only win in ultra-liberal states, and even in ultra-liberal states we sometimes lost (California). But now we're winning in the heartland, and even in a Republican-heavy state (Iowa) polls show that voters support gay marriage after it's been legal for almost five years. In a southern state, Virginia, 56% support gay marriage. That exact number-56%-is the majority that voted against gay marriage 7 years ago. This tide is turning fast.

    I agree but it seems that many of the "heartland" states will legalize it only by court order, like Iowa did, and in the reddest of states, by federal court order.

    I saw some article that said that 52% of people in South Carolina oppose same-sex marriage. Just 52% in SOUTH FUCKING CAROLINA?!? The tide is most definitely turning!
