LGBT News Judge partially strikes down Kentucky's ban on gay marriage

    A federal judge ruled today that under the Equal Protection Clause of the 14th Amendment, Kentucky must recognize gay marriages performed out of state, based on the US Supreme Court's ruling in Windsor V. United States last June.

    US District Judge John G. Heyburn II stated in his ruling,

    "Religious beliefs ... are vital to the fabric of society ... assigning a religious or traditional rationale for a law does not make it constitutional when that law discriminates against a class of people without other reasons."

    It's important to note that the ruling does not compel Kentucky to perform gay marriages in the Bluegrass State. The ruling was handed down at around noon, eastern time, so there are no press releases yet from Kentucky government officials commenting on this ruling. More to come later.

    Proud of my adopted state, and honestly I think this is the constitutional path toward marriage equality being the law of the land.

    This really does mean that other states may soon be forced to recognize marriages, as they do with straight marriages, performed out of state. Even if they don't allow them to be performed in their own state.
    Works for me :grin:

    I think they can now recognize same-sex marriages in other states. When Illinois starts handing out marriage licenses in June, you guys can just come up here, get married, and be on your way. :stuck_out_tongue_closed_eyes:

    It's not exactly legalized. Only out of state marriages can be recognized. But, New Mexico would be the first southern continental state to do so. :slight_smile: Regardless, it's a step in the right direction.

    This makes another twist in what will come from next week's trial in Detroit. Starting to look like the situation is going to look more like cousin marriages than interracial marriages, though.
