LGBT News Michigan legalizes same-sex marriage

    Judge finds Michigan gay marriage ban unconstitutional | MLive.com

    A federal judge in Detroit has struck down Michigan's ban on gay marriage. The ruling has been stayed pending appeal by Republicans Rick Snyder and Bill Schuette (Shoot-ie), the Governor and Attorney General, respectively. Michigan Democratic nominee for Governor Mark Schauer had this to say,

    “This is a major victory for loving, committed couples across the state. While I know there are differing views on this issue, I firmly believe every Michigander deserves equal protection under the law, and today’s ruling reaffirms this fundamental American value.

    “Michigan’s marriage equality ban hurts our economy by making it harder to attract highly-skilled workers and entrepreneurs. It’s time for Gov. Snyder and Attorney General Schuette to accept this ruling, and stop wasting Michigan taxpayer dollars on a costly appeal.

    “As Governor, discrimination will have no place in my administration. I’ll wake up every day focused on rebuilding our economy, and protecting the rights of all Michigan citizens.”


    Judge Bernard Friedman said this in his ruling,

    "In attempting to define this case as a challenge to 'the will of the people,' state defendants lost sight of what this case is truly about: people.

    "No court record of this proceeding could ever fully convey the personal sacrifice of these two plaintiffs who seek to ensure that the state may no longer impair the rights of their children and the thousands of others now being raised by same-sex couples.

    "The assertion is a negative assumption about same-sex couples without
    basis in reality... Even if, counter-factually, there were a difference in outcomes, the State does not exclude from marriage those who belong to groups that have been documented to be less likely to raise well-adjusted children; for this reason, too, there is no rational basis for the MMA (Michigan Marriage Act)."


    I must say, I've never been this proud to be a Michigander.

    As a Michigander, I am so so happy. I just saw this a few minutes ago, and I am just so glad the right result was achieved. This is such amazing news! I know so many LGB people living near me alone, let alone across the entire state, so this is just such great news.
    And another state down, one step closer to equality across the country!

    Wow, maybe me and my partner will be able to move back to Michigan, one day, and still be able to be married!

    At the same time, there are SO many appeals going on in so many states, that I hope all goes well.

    My big worry is that it goes to the Supreme Court, sand things go bad there. I really hope not, though.

    From what I can find a stay has been requested but not yet approved. If you have seen differently, can you post a source?

    I'm trying not to get choked up, but this is so great for so many families here in the Wolverine State. Unfortunately we're not getting married any time soon, but for the first time in a very, very long time, I'm proud of my home state and I'm proud to be a Michigander.

    Detroit is actually pretty liberal, and not totally a wasteland :slight_smile: It's among the areas that keeps Michigan blue in presidential elections. It's the rural areas up north, that tend to be more conservative...I grew up near Traverse City, and that was always pretty heavily Republican, though now, it's starting to become more evenly split.

    But I'm glad the state where I was born made this ruling, and hope that it stands.

    As EC's resident MI County Clerk employee, I should mention that those planning on getting a marriage license as a result of this decision still must get the license from the county where at least one of you live, and you should contact your county clerk's office before trying to apply. Some county clerks will need to clear this with their county attorney before accepting any applications. If they are issuing marriage licenses to same sex couples, it is highly unlikely that they have changed any of their other policies/procedures for issuing licenses, and most counties will list their local requirements on their website. If you are divorced, you will most likely need a certified copy of your divorce judgment, you may need a certified copy of your birth certificates as well.

    Oh, and HuskyPup, there are some parts of Detroit that are total wastelands. Though, they have been working on demolitions in those areas.

    Yay!!! I saw this on the news earlier and I couldn't believe it. Tbh, I thought they were going to postpone their decision, but I am so relieved that they finally came to their senses! Now, I just have to find the right woman and make her my bride to be...

    according to the Detroit News Ingham County, and Macomb county will begin issuing licenses Monday morning if there is no stay.

    The AG messed up his case so badly, he doesn't even deserve to have an appeal.

    I've been trying not to be too over excited about this, considering not everything is finalized and nobody can be married immediately... but I can't help it. It's such a huge step forward. Those two women are my heroes.
