LGBT News Federal judge upholds Louisiana Same-Sex Marriage Ban

    Louisiana Judge upheld ban on same-sex marriage, this is the first time in the last twenty some rulings that the ban has not been overturned.

    And appointed by Ronald Reagan, who in my mind was, and still 'is' among the most evil Republicans that have ever lived.

    Sad, but 'ol Ronnie was pals with Pat Robertson, Jerry Falwell, and in fact started that whole strategy of courting the 'religious right', and building up their political clout as a means of keeping power.

    Now, here's the bitter fruit of that legacy; the same legacy that upheld Sodomy as being illegal, and would not be overturned until the Clinton era.

    I hated Ronald Reagan as a punk kid with a mohawk in the 80s, and I hate him today.

    It won't matter. The ruling will be overturned in the end. It's just the ruling from some old bigot trying to give things one last ha-rah.

    I hope it gets overturned.

    Until SCOTUS weighs in, it seems things in so many places are pretty much 'stuck' as they are.

    Louisiana is the same state that didn't overturn their sodomy ban last year. (It's even unconstitutional because the Supreme Court ruled against it in 2003).Did anyone really expect this state to rule in favor of same-sex marriage when they can't even overturn a ban that was already struck down by the highest court in the USA?

    Anyways, I really don't think this ruling will matter in the end. This judge will probably be shamed in the future because support for same-sex marriage is raising fairly quickly. Hell, if it's legalized for the nation, can you imagine how shitty he'll feel?

    His reasoning is very poor and has some facts wrong or at least he has an odd understanding of certain documents. He says heightened scrutiny was warranted in Loving because the Fourteenth Amendment expressly condemns racial discrimination as a constitutional evil, but in fact, the Fourteenth Amendment doesn't expressly mention race at all.

    It was going to happen sooner or later.

    If it's appealed does it go to SCOTUS or is there a level below that?

    It goes to the level below that, I believe. However, the gay marriage cases from other states are already sitting at the doorstep of the SCOTUS. It's just a matter of whether or not they take the cases. So, in the end, it's a moot point. The SCOTUS is likely to hear the case and make a ruling before this one works its way all the way up to them. It's also almost certain that this judge will have his opinion overturned.

    The marriage equality cases in other states have been put before conservative courts in the past which have ruled in our favor. I am confident that the trend will continue. This is just some old bastard giving us the finger before the SCOTUS ultimately legalizes marriage equality nationwide.

    This judge ignored the true question and issue at hand.
    This judge used the old lame excuse of what if.
    What if someone wanted to marry their Aunt, a goat, a dog, a table lamp.
    The cornball excuses long debunked, yet brought up again by this judge.
    The plaintiffs are not asking to marry a dog, an aunt, a lamp.
    So to even bring this into the case is nonsense on part of the judge.
    Obvious this judge just wanted to make headlines and toot his own horn.

    Totally ignoring the legal case before the court.
    Injecting nonsense to justify his ruling.

    They will take this to the 5th circuit court, where this ruling will be exposed for what it is, a ruling having nothing to do with the facts of the case, and soundly overturned.

    And I still believe this will never see the US Supreme court, or need to.
    The high court will have no reason to take this on after unanimous federal court rulings knocking down ban after ban. And add to that Louisiana, after the 5th circuit court overturns today's nonsense ruling that relied on craziness having nothing to do with the case before the court.

    The plaintiffs were not asking to marry an aunt.
    And using some "what if" excuse in attempts to justify this nonsense ruling having nothing to do with the question at hand before the court, you can be assured the 5th circuit court will make the correct ruling.

    The questions before this court were with addressing the states same sex marriage ban, and addressing how allowing SS marriage harms other legal marriages.
    That was the issue before the court to address.
    Not marriage between aunts, dogs, cats, lamps nor space aliens.

    Even conservative republicans can see thru this joke of a ruling.
    And that includes every conservative republican sitting on the 5th circuit court.
    The only thing this judge will accomplish in the end is to make a laughing stock of himself.
