For justice Kennedy to be getting in the way, it can mean he might want same-sex marriage to make it to SCOTUS. Even though he is a republican, he has said some very promising things when he ruled in favor of striking down the gay marriage ban in DOMA last year. He's basically the swing vote if it does make it to SCOTUS, given the 6th circuit ruling is expecting to rule in favor of keeping state bans on gay marriage. It would be interesting to see how this unfolds...
I was thinking Nevada would be among the next states. It's funny...now Arizona is surrounded by gay marriage. Sadly, I can see this as being among the last states, or at least one that will put up a fight. Hopefully, we'll see several more states soon. Maybe the cases in Michigan, Ohio, Kentucky and Tennessee will be come out ok...the circuit court could be swayed by recent precedent setting events. Or at least I try to be optimistic, because I'd like to move back to Michigan one day, and be able to be married to my partner there.
I doubt Arizona will put up a fight. Yes, they had the "discrimination law" thing, but the people reacted VERY quickly, saying "Whoah woah woah, hold it right there! Our representatives and senators aren't really doing their job! We're more friendly than you think!" If they're smart, those same politicians won't pull the same shit again.
Considering how many times both the Democratic Party and Republican Party have changed major political ideas, it's not really fair to assume that an old white republican is all anti-gay, anti-secular, etc. Same goes vise versa with the democratic party.
I don't assume he's anti-gay. I know Kennedy is pro-gay. I've discovered he let Idaho appeal because they issued an emergency appeal minutes before the deadline. If Kennedy didn't let the stay happened, it may cause problems in the momentum of same-sex marriage. So he's really trying to create a solid end outcome. Which is great.
