    "WASHINGTON — Gay and lesbian couples filed a petition on Friday asking the Supreme Court to decide whether there is a constitutional right to same-sex marriage. It arrived eight days after the United States Court of Appeals for the Sixth Circuit, in Cincinnati, upheld bans on same-sex marriage in Kentucky, Michigan, Ohio and Tennessee.

    The fast pace of the filing was an effort to ensure that the justices be able to hear and decide a case before the current Supreme Court term ends in late June.

    On Oct. 6, the Supreme Court surprised most observers by turning down petitions seeking to appeal rulings striking down same-sex marriage bans in Indiana, Oklahoma, Utah, Virginia and Wisconsin. When the Supreme Court acted, there was as yet no disagreement among the federal appeals courts, a criterion the justices often consider in deciding whether to agree to hear a case.

    The Sixth Circuit’s decision changed that, and a Supreme Court review is now likely."

    It would have saved everyone a lot of time if the Supreme Court made a more concrete decision earlier. Sorry to all those in states that are still in deadlock.

    I really hope this doesn't erase the gains made in so many states, or slow down future gains. This has the potential to be a huge disaster, and I'll have to say, I'm not very confident...If it's ruled to be a 'Sate's Right's' issue, this could reduce the legal states to a scant handful.

    I'm actually cautiously optimistic. Look at it this way: SCOTUS needs 4 justices to want a case to be heard for it to be heard. Now, you would think with the Roberts 5 (arguably the most partisan, corrupt court in the nation's history) would have 4 people object to have the cases in Utah, Kansas, Indiana and other states heard when appellate courts upheld the same sex marriage bans unconstitutional. They couldn't get 4 of them to sign on to hear the cases. That would mean that other than the 2 blatantly homophobic justices Scalia and Thomas, Alito and Roberts may not be as backwards on this issue as we think, and Kennedy won't backtrack on his current gay rights record.

    I actually think Michigan's case would have a good chance at succeeding. Since your case was about adoption, not "religious freedom", it would be interesting to see how it plays out in SCOTUS.

    Sorry for sounding stupid, But is there anyway all 50 states could all marriage equality if Supreme Court does take the case?

    Yes, if SCOTUS rules in favor, then it would be legal in all 50 states immediately.
