"This court does not believe that the 86% of Mississippians who voted against same-sex marriage in 2004 did so with malice, bigotry, or hatred in their hearts."

That's the stupidest thing I've ever read from a court of law, and it's not offset by anything else in the opinion.

Still, good for you folks. I'm glad the judiciary can protect you from a vicious public.

Well, I like that the judge is forcing the 5th Circuit's hand. "This decision is stayed for 14 days," which means that the order will automatically allow same-sex marriage should an appellate-level court not intervene (i.e. Fifth Circuit Court of Appeals or the US Supreme Court).

For the 5th Circuit (composed of TX, MS, and LA), 2 judges in Texas and, now, Mississippi have overturned their respective states' bans against SSM (with stays). Louisiana was the only state where a federal judge upheld the SSM ban.

I completely hate the Court of Appeals for the Fifth Circuit. Just putting that out there. I'm also really not excited for any of these to go to the Supreme Court (including Montana's case, which Tim Fox is going to auto-lose in the Ninth Circuit, meaning Tim will ask for writ of certiarori to the Supreme Court.)

Then the fate of millions will be decided by what side of the bed Anthony Kennedy woke up on that morning. Is this what we want???

On the other hand, Ruth is not getting any younger...

I know I should be happy for that state because I am. I never thought I'd see the day where MS gets equality before we do here in MI. I feel like everyone is going to blame us if the Supreme Court's decision goes the other way. Uggh.

Yeah, she had heart surgery today. I think she will be OK, but it shows what a thin line there is.

If SCOTUS decides that the district courts don't have the right to make such decisions, it could roll back the number of states with legal same sex marriage to just a handful, just like that...which is a distinct possibility, especially given the very, very conservative 8th circuit has yet to weigh in, as well.
