I don't see why he brings up "God" when McLaughlin himself cannot follow his own religion.

There is no way this would pass... but if it did, (which I totally doubt), there will be a war going down in California.

The law is based on religious conviction, so is cuckoo as far as I'm concerned. And it also seems to violate the 8th Amendment, so there's that.

All you folks citing logic and reason and actual laws here are exerting too much effort in the face of the void

I think people are missing the larger point.

It is obvious that this amendment will not pass, and will almost certainly not get enough signatures to even be on the ballot. Even in the one and a trillion chance that it did achieve both of those hurtles, it would be struck down in the courts immediately.

The point is there are nutcases out there who are actively seeking a way to kill us simply for existing, and they are going to go ape shit once marriage equality becomes legal nationwide. They are going to be riled up as church after church in the country talks about how Christianity is under assault, blah, blah, blah... All it is going to take is one guy like this with a screw loose and a gun to hurt a lot of people.

It's worth remembering that we have our own Christian version of ISIS right here in America, and they are dangerous terrorists that we need to keep an eye on.

This is really cool! I actually like this...

I think stuff like this is needed to remind us of the fact that people really do want to kill us. People think I'm being alarmist and extremist when I say that. I've always said that bigots want to use the State to do as much violence to us as they possibly can, and the only way that's going to stop is if we start to bash back.

We're not going to fucking love and educate our way to a safe world for queer folks.

Is conspiring to commit homocide/genocide not a crime? Because this dude should clearly be locked up.

I realized that going to law school (not me) and passing the bar does not necessarily a sane person make a while back. I think he's a dime a dozen type who is looking for attention ... in a bad way. I'm thinking this will be his career high.

But Huntington Beach? Huntington Beach? Really?

Another thing: someone needs to do a psychiatric work-up on him ... quickly.

The advocacy of this kind of political speech doesn't meet the "imminent lawless action" standard of Brandenburg v Ohio.

So we can't lock him up. But what we can do is pay attention to him and people like him. We need to be able to identify these people and maintain intelligence on them and then exhaust all legal methods to display as much hostility to them as we can, whether through public criticism, boycotts, and refusal of service.

I heard a great joke about lawyers:

98% of lawyers make the other 2% look bad.

The sad thing here is that I'm more confident that it will pass than anything else.

Looks like I might have to look around every corner in July.

I mean fuck life, liberty and the pursuit of happiness. The constitution exists, but the reason why the United States became a thing seems to have been forgotten and denied.

I want to be patriotic, I really do. We've got a pretty cool President, but laws denying people "certain inalienable rights" under the guise of "religious freedom" being passed left and right just point to this being passed, and nobody really doing much about it.
