LGBT News Mexico (effectively) legalizes Gay Marraige

    Well, this is nice to see!

    I guess the US will be the last country in North America to do so.

    With Little Fanfare, Mexican Supreme Court Effectively Legalizes Same-Sex Marriage: The New York Times.

    I'm very happy for friends in Mexico...now, the US needs to step up to the plate, and get with the times.

    On a side note: I wonder who the first right wing wack will be to say that this is one more bad thing about 'those Mexicans' trying to sneak over. It shouldn't take too long...

    Also of note:

    "Argentina, Uruguay and Brazil already allow same-sex marriage. Chile plans to recognize same-sex civil unions this year; Ecuador approved civil unions in April; and Colombia grants same-sex couples many of the same rights extended to heterosexual married couples."

    It's actually funny. My mom is from a Mexican state where I could have gotten gay-married since last year and civil unioned for a while before that. Ironically, I have fewer rights as a gay American living where I was born and where my dad and his family are from, "the land of the free," than Mexico.

    Also, I heard that the Supreme Court is going to make the decision at the ending of this month on their ruling on gay marriage.

    Mexico while they lack many qualities have a lot of things I would desire compared to the US and glad to see they have gay marriage now.

    I heard this ruling doesn't "legalize" it in the whole nation since their court system works a little differently. I heard all the ruling did was make all gay marriage "bans" vulnerable.

    That is, unless something changed in the past few days? Wiki still shows it as banned in most parts. Still... good news :slight_smile:

    It is still a bit ambiguous.

    From the article, the court ruled,

    “As the purpose of matrimony is not procreation, there is no justified reason that the matrimonial union be heterosexual, nor that it be stated as between only a man and only a woman,” the ruling said. “Such a statement turns out to be discriminatory in its mere expression.”

    So though it doesn't exactly make it 'legal', it means it has to be nationally recognized. The drawback is that in some places, couples will have to spend up to $1,000 to get a court injunction, in order to be married in that state, or by a certain magistrate. Though they could also go elsewhere, to be married.

    It's not perfect, but a major step forward.

    I guess it sorta resembles the North Carolina situation, in ways, where you have magistrates who will refuse to marry you. But here, at least the court has ruled that to do so is discriminatory, period.

    Hopefully things will become more uniform in how this works, but I'm still happy to see progress.

    But it was already recognized throughout the whole country. :/ Unless I'm missing something.

    True, though this opens it up to marriages being able to be performed in many more places.

    This is extremely good news. I've personally witnessed the pain and anguish on the faces of LGBT Mexicans before this decision was handed down.

    From my understanding it works like this:

    Mexico has a judicial system where 5 is the magic number. If state judges decide the same outcome on 5 different cases (related to same-sex marriage in this case), then the state has an obligation to respond in whichever way is appropriate to the outcome of those rulings. That is how the state of Chihuahua just legalized it. There are several states which have reached the 5+ rulings, and many more are somewhere in between the 1st and the 5th.

    It's happening at a much faster rate than anyone would have thought, however. It also has happened quietly, suggesting that Mexicans aren't willing to make the same fuss about it as Americans do.

    Lol sadly Mexico has stricter immigration laws than the US but they complain when we deport illegals back to their country. They are hypocrites and yes illegals should be deported back but i love Mexico for the stance on steroids.
