An interesting, yet bizarre article today. Under UK law Adultery is defined as penetrative vaginal sex, so when a woman found out her husband had a gay affair she was unable to claim adultery for a divorce. Even more bizarre, in a 'gay marriage' the same law applies, so you can only claim adultery if your husband has sex with a woman.

There is also no consummation requirement for gay marriages, whereas without consummation (defined as vaginal intercourse) a heterosexual marriage may be deemed invalid or annulled on those grounds later.

Its funny but I think it is likely the law trying to be very careful to not seem homophobic or excessively policing gay people. Plus it would mean the law would expect gay anal intercourse (or some form of penetrative intercourse for lesbians) which would be seriously overstepping the line since not all couples engage in such acts. Homosexual sex is much more "mysterious" in that respect.

Still though, consummation in general is pretty weird. It would probably be best for the law to be revised to require "intimacy" to validate a marriage rather than specific sexual acts.
