    If she says no and doesn't do her job. She is eligible to get terminated and I honestly think she deserves to get fired anyway.

    Breaking news as of this morning: Kim Davis has denied marriage licenses to at least two same sex couples (saying she cannot grant them licenses under "God's law"), and reportedly police have been called to the scene by Davis to make at least one of the couples leave. The Rowan County Human Rights Coalition has set up a protest both in and outside the courthouse, and are chanting "Do your job!" at Davis. Anti-LGBTQ protestors have also made their way to the scene to rally support for Davis...

    Honestly, she needs to be held in contempt of court at this point. She has repeatedly broken the law, and I'd like to see Governor Beshear send the National Guard there to make her grant licenses or arrest her, and also call Kentucky's General Assembly into a special session to remove her from office and schedule a special election to replace her.

    This bitch is totally being used by the Christian right through the Christian law firm that represents her: Liberty Counsel, that has been quoted as saying that "the fight is far from over". Imagine that, a law firm egging her on despite their defeat at the Supreme Court.

    Clearly this is disturbing, they will stop at nothing, SCOTUS or not...as for her, the term "useful idiot" applies perfectly, a moron willing to become a martyr for the cause.

    On Thursday she will be standing in front of a judge for contempt of court, she can expect heavy fines...which will likely be paid for by a deluge of crowd-funded Jesus Bucks...

    The ACLU stated that they don't want to see her arrested. Why not? She's clearly in concept of court, she knows she is and has been ordered more than enough times to issue these licenses.

    Gives the religious right a martyr to rally round. Doesn't get couples any closer to get licenses in the county either. Could be wrong though.

    It seems to me in this case, she's still working there because her employers see no reason to terminate her employment. Having said that: labor law functions separately and apart, the amount of detritus created by beginning termination of an employee can be daunting. It may seem that nothing is being done, when in fact the hold up comes from the (necessary) protections that exist to stop employers from using unlawful termination.

    The ACLU doesn't want her arrested because the ACLU is a pusillanimous organization. That's why.

    (Actually, I don't want her arrested either. I just want her fired. I also want to make damn sure that everybody knows her name is Kim Davis, and the United States never implements a European style Right to be Forgotten.)

    She can be removed for misconduct by the state legislature, it appears the Attorney General has no patience for this nonsense. The shit-storm that will befall this "martyr" will be a spectacle to enjoy.

    Dare I say it will be of biblical proportions.

    Probably because she's such a nutcase that she thinks that if she's in jail that she's a martyr for her religious beliefs. She'd get a lot of publicity from it, which is partly what she's seeking anyway. Plus, with all her supporters there, they probably don't want a bunch or armed rednecks to interfere with it.

    If she was honest and not a hypocrite, this isn't about her religious beliefs, or she'd just quit. She wants to continue making money from her gig. Fining her might take away some of that money. The ACLU probably thinks hitting her in the pocketbook would be more effective. I don't know if that would work though, because some ignorant people would fund something to give her money, probably more that what she's making now anyway.

    She isn't even being asked to perform weddings, her only job is to sign off on whether or not the couple are legally allowed to marry under the current laws of the state, nothing more. She claims that this is against "God's law" but the US constitution doesn't allow for her particular religion to be the law. This is the USA, not Iran. She hasn't in the past had any problem issuing licenses to atheists, (who according to her religion are going to go to hell because they don't accept God)
    or divorced people (particularly since she's allegedly been divorced four times)

    As far as the questions about why she hasn't been fired, her's is an elected position, she can't be fired. She can possibly face a recall challenge. She can technically be removed by the Kentucky legislature, if they've got the political guts to do it, but they're not in session anyway. Calling a special session for something that might not pass anyway would be very expensive.

    There is a very conservative talk radio station in Cincinnati where all the hosts are moderate to far right wing republicans, and they've all said that she is wrong to keep her job and not do part of it.

    Problem with fining her is any amount is going to get paid by the inevitable fund set up to help her. It's highly unlikely she's going to end up out of pocket in the long run, even if she does end up losing her job.

    As a side point, the fact this has been allowed to get to this point makes me doubt the stomach being there to actually enforce Obergefell. I see carve outs for people like Davis coming down the pipe.

    I find the thread comments more fascinating than the story, but...

    If this woman is really going to cite "God's Law", then she should render unto Caesar his, which in this case would be the government that allows her this position, and do her job.

    But I am forgetting the well known verses:

    4. And the Lord said, "If the gays ever require written documentation, backed by the governmental body, deny them. For it is written, the homos shall not enter the Gates of Heaven, but instead flung into the fiery pits of Hell."
    5. But the gays did not listen. They received their written documents, and the world entered perpetual darkness and debauchery. This is what was meant by Hell.

    Perhaps the judge can make it a continual fine, such as saying she has to pay $10,000 per day she refuses, with the daily rate going up after so many days. If that's legally possible, those Jesus bucks would end up being a bigotry tax that would eventually run out.
