LGBT News Deputy clerk to continue issuing licenses even if his boss says no

    I was under the impression that the federal judge told Kim not to interfere with her deputy clerk's work. So... either she gets thrown in jail again or we witness some fight about freedom to issue marriage licenses (i.e. do your job).

    It's very important to mention here that the ultimate reason Kim Davis was jailed for being in contempt is that the judge asked her deputies if they would issue licenses, and then asked if she would not interfere with them following the law. She refused (indicating that she might place her subordinates in professional jeopardy).

    Right now, the deputies are quite well-protected. If she tries to fire them, really for any reason at all, they will have ample grounds to sue for wrongful termination. No matter what justification she comes up with, they will be able to make the argument that the justification was a ruse, and it's really just retaliation.

    Any wrongful termination case would be so open and shut that that a pro se litigant could shitcan her HR department.

    After all, her refusal to let the deputies follow the law is now part of court proceedings, and therefore will become judicially noticed.

    Look, it shouldn't be legal for her to deny marriage license to same-sex couples, but if she can, I'm not going to be that fussed; when her co-workers have the right to do so, and she still denies them AND tries to fire them, then that's the final straw.

    Her not doing her job is one thing, but now she is undoubtedly pushing her religious views on others. Please, keep your religious hands off my secular government. And while you're at, come out of the closet already; 4 marriages and being anti-gay is pretty telling sign.

    She's been told directly by the Supreme Court to issues the licenses, and that because of the recent SCOTUS ruling, all marriage licenses are valid. Furthermore, as said above, she's been told not to interfere with Federal work, ie. the work done by the deputies. Even more, she's been mentioned to have inentions of denying their request order. You'd think being sent to prison would be a message, but nope.

    The judge did, but her lawyer has said that she plans on continuing to do what she did before the jail time (refuse to do it and refuse to allow her deputy clerks to issue them) What is unclear right now is what she will do if she tells this guy not to issue licenses, and he does like he said he would do, then what? If she does nothing to this guy, she won't continue to get her 15 minutes of fame, and she looks like she likes the attention.

    Technically she wouldn't have to fire anyone, she could just send everyone home or give them days off except for the one deputy clerk that's backing her (her son) and let her supporters run interference for her while she continues to hide in her office. She wouldn't be able to get much county clerk business done, but it's not like she cares about that anyway. Under Ky law she can't face a recall election, and the Governor's already said that they're not going to hold a special session to do anything. Regardless of whether she sits in jail or her office, she'll still get the attention she craves, while continuing to collect 80 grand a year.

    If you're talking about money, there is one positive aspect however for the restaurant and hotel business in that county. All of the people on both sides of the issue that have come into the county have to eat and sleep and get gas somewhere. Someone once said that sometimes even negative publicity is better than none at all from a business standpoint. :rolle:
