    Many Slavic countries have struggled with LGBT rights, even the better integrated countries into the EU such as Poland and Slovenia. This is a pity, but at least it doesn't mark a step backwards, legally, such as with the horrendous constitutional bans on same-sex marriage in many states in the former Eastern Bloc.

    Although this did bring out Anita Bryant-style rhetoric; the Children Are at Stake campaign scarcely hid the message trying to link homosexuality to paedophilia.

    This is definitely a setback to the gains made this year. Slovenia is also heavily Catholic, and the Pope speaking out against this might have made a lot of Iinfluence. So much for "Who am I to judge?"...

    Wonder how the Catholic church would respond if a country put their rights up for popular vote.

    The parliament can still pass the legislation, referendums are not legally binding and are merely a directive by the electorate to carry out a specific action (in this case the action is to not allow SSM). However, at the same time as I am the greatest defender of democracy, I am too it's harshest critic. This vote can only be called tyranny by democratic majority, based solely on prejudice and ignorant opinion; this is the downfall of entrusting decisions with people who have no accountability to anyone other than themselves.

    The parliament could very easily claim some sort of human rights legislation (or just common decency) to pass this in disregard to the referendum.

    Foz, the referendum is binding according to Slovenia's constitution (Article 90) so long as a fifth of the voting population reject the law, as did happen. If the National Assembly were to try to repeat the act through a similar law, at least the 40,000 people necessary would again request a referendum as they did this time and the same thing would undoubtedly happen. They can't disregard the referendum.

    The Constitutional Court did at least hint that it would hear challenges to individual discriminatory laws on the basis of Slovenia's constitutional provisions for human rights and equality before the law, which may ameliorate the failure of the marriage law.

    That's somewhat odd to hand over that amount of parliamentary sovereignty to the electorate, I'd certainly not expect it in that part of the world!

    I see your point, but, unfortunately, the referendum makes the ban very legitimate, in a democratic light. It would be very disrespectful if elected officials ignored the people's choice.

    While this is certainly a setback, it doesn't surprise me at all. Well, this battle was never supposed to be easy anyway and I actually think the LGBT movement has made more advances than what was expected these last years.

    Some countries (Ireland for example) have to have a referendum to decide on a new law, no way around it. Slovenia might be like that
