    Mesa, AZ student arrested for indecent exposure in yearbook pict - KAUZ-TV: Newschannel 6 Now | Wichita Falls, TX

    Hunter Osborn, 19, was charged yesterday with 69 misdemeanor counts of indecent exposure and one felony count of furnishing harmful content to minors. On a dare, he exposed the tip of his penis during the preseason football team photograph, which made it into promotional materials. It wasn't noticed until recently, when the photo was printed in the school yearbook. He's facing 69 counts of indecent exposure because of the fact that his 69 teammates were around at the time the photo was taken.

    Count this as another reason that I could never ever be a prosecutor. Ruining a kid's life over a stupid prank. It's not like they never saw him naked in the locker room. Hopefully they'll reach a plea agreement where this won't stay on his record, because as it stands now, he'd be registering as a sex offender for the rest of his life.

    I'm into photography - - - and I was also on the yearbook staff. This blows my mind!

    First, he was a complete idiot for doing so. I never condone any of these actions because at 19, I was volunteering at a free health clinic.

    However, if it was apparently so obvious and soooooo horrible, how did someone not notice it? The photographer? The yearbook staff? We were always meticulous in what went into the yearbook. Always.

    I just don't get how this has blown up so bad.

    I don't get how this was not noticed until now. You th I no that a community member, yearbook staff member or student would have noticed this image. More than anything, this shows that the school does not properly screen photos before they are in the yearbook or other materials.

    See, I wonder if someone ratted him out. Like, I am sure he told friends - - and I am sure someone saw - and it probably got around. Obviously they are going to blur out the picture, but at that distance why didn't someone lie? Like, "that's just my finger!"

    Yeah, that's what I was thinking. There had to be something else going on here for people to notice it if they had missed it so many times before.

    Apparently the image was so small when used in promotional materials for the football team that nobody noticed. But when it was printed in the yearbook, it was big enough that somebody noticed and started showing it to everybody.

    Isn't in-school discipline enough for this situation? While technically he broke a law, it's still a technicality. Did he commit the same crime by showering in the locker room after games, since during the season he would have been 18, while his teammates were technically underage?

    All teenagers should be aware of the growing abuse of the sex offense laws, to prosecute teenagers who "sext" and send photos to other teens, for such felony offenses as producing "child pornography."

    An internet search for these kinds of cases will convince you, with a disturbing trove of felony prosecutions all across the United States.

    Knowing American law they probably count this as something stupid like child pornography and/or indecent exposure in front of minors.

    69 Counts? Because it is in front of his teammates - what in the actual hell is that logic.
    1.How many people are actually facing him?! ONE, the cameraman.
    2. since when has this logic worked with indecent exposure. If I streak in Times Square on New Years Eve would I be charged with 1,000,000 counts of indecent exposure and eligible to spend many lives in prison?
    3. Can you even see anything...seriously. It is your standard blurry team photo where you can barely make out people's heads, let alone people's...heads. :lol: Plus its in the shadows, it could be anything!

    This reminds me of when you have kids sexting each other charged with "distributing child pornography" for Pete's sake! It's like, it is their junk! How can they be simultaneously the victim and the perpetrator? How can they criminally exploit themselves?!

    The thing of it is, years ago, the Supreme Court came up with an obscenity test (known as the "Miller Test") to ascertain whether an image or video is obscene. It's a three-pronged test, basically, that the depiction has to lack any redeeming artistic or literary value, that it must appeal primarily to the prurient interests of the viewer, and that a reasonable person in the local community would find the depiction obscene. ALL THREE of these have to be met before a depiction can be considered obscene. This depiction fails on at least two of the three, and arguably on all three.

    It's also quite well grounded in case law that non-sexually explicit nudity is not considered obscene, nor is it even considered pornography (obscenity and pornography are completely different.)

    So there's no way these charges of obscenity would stick. It's arguable whether one could even charge indecent exposure, and furthermore, of the 60 some students in the picture... none of them even would have seen the guy's penis at that point.

    Oh and... I would wager that most everyone on that team has seen most everyone else's penis at some point in the locker rooms and showers... so how can they argue that people were injured by viewing a microscopic, fuzzy, unrecognizable outline of a penis in a yearbook picture that was probably 10 pixels by 10 pixels, when the same kids have likely seen the dude's junk (along with everyone else's) dozens or hundreds of times in the locker room?

    Yes, it was wrong. Yes, he should get some sort of reprimand for this. But criminal charges are just asinine.

    If I had been prosecutor and wanted to charge him, better if he had been charged with criminal mischief for knowingly causing the destruction of school property.

    I disagree with the majority of this thread. Normally, I support being more lineant with teenagers, but he's 19 and children are going to see that. He should know by now that that's wrong. Most elementary and middle schoolers know that what he did is wrong, it looks like he needs to take responsibility at some point, because his behavior is indicative no ever really taught him to.

    Oh the youngest ones are 14 it's not like they're 5. Plus I wouldn't mind seeing him especially because he seemed pretty confident.

    I totally agree with you. He is old enough to know the difference between right and wrong. It's a really stupid thing he did. He had to know that what he was doing was not okay?
