Mass. Says Federal Marriage Law Unconstitutional

    Jeez... I wish the US would make up it's mind if it wants the Federal Government to control ALL the states or the States to control themselves, or to divide the powers just like Canada has in the BNA act... where each province has control of various things like: education, driving laws and Federal government defines horrific crimes like murder (the same) and controls the prisons etc.

    Still... I'm glad someone is standing up for the right for any legal adults to marry one another whether they are opposite or same sex couples. Go Mass.!

    how different is this ultimatelly to Perry Vs. Govanator?

    I think mass should sit on its hands until the california trial... that way, we might set legal precedence.

    Republicans are all about state rights and letting the states decide everything... except when the states aren't doing what republicans want. Then they go to the federal courts to get what they want.

    Gore vs Florida is an excellent example of this, and the Defense of Marriage act is another.

    Technically power is divided between the states and the federal gov't; The problem is, which powers belong to whom is not very well defined in the constitution. Right wing Republicans and Left wing Democrats tend to go back and forth on what powers are reserved for the states and which aren't.

    This is challenging DOMA itself. Perry vs Govanator is more or less challenging just Prop 8. Least that's how I see it.

    Honestly, if anyone looks the situation objectively they will see that it is unconstitutional to deny people rights based on any reason.

    "I object to same sex marriage for religious reasons." Answer: "Separation of church and state." What about all those religions that ritualized homosexuality?
