    And this is where a lawsuit should be files against the Federal Government. This clearly shows that the DOMA is violating the 14th amendment. They should not have even let it get this far. They need to file for injective relief immediately so that he is not deported while the courts sort this out.

    --edit to add. Just reread the article. They have filed for relief. They are just waiting for the hearing. Of course they do share some of the blame here. He was here on a tourist visa. He should have filed for proper immigration status long ago. Still if the whole get married thing works for straight couples it should work for gay couples.
