Honestly, wishing for people to be brutalised and dehumanised in prison isn't going to undo the wrong they did OR going to make them better people. And I think enjoying vindictive fantasies is not healthy for anyone.

So, personally I'm just hoping that whatever punishment he gets will teach him to reflect and try to make up for what he did in whatever way he can. that will never undo the crime, but I'd rather have him become a better person than enjoying his life being ruined too...

I hope that they lock him up in prison and throw away the key.

If someone has it in them to premeditate and shoot someone, can they ever be fixed?

That's the big question... can people who do things like that even be rehabilitated?

Well then, let's kill him to teach people a lesson that killing is bad.

    ... I'm a bit confused.

Double Jeopardy wouldn't be nullified simply by dropping the hate crime charges. Are they trying to charge him for something else?

Double jeopardy only applies to completed trials with a verdict. The previous trial was a hung jury.

I just watched a special on the case. The whole "gay panic" defense is ridiculous. Yes, I would call it a hate crime, and I think the kid who did it should go to jail and should be tried as an adult. I don't think he should get the death penalty, and I understand why the jury was hung. The kid had a bad background, which isn't an excuse but does add depth to the case. I really hope he is convicted. It's an unfortunate situation for everyone involved, but I don't believe his crime should go unpunished.
