    That depends on the dumbass activist conservatives on the Supremes, and very possibly on Justice Kennedy, who is usually the swing vote on these issues. It seems certain that the asshat conservatives will vote to continue the ban, using some bullshit justification that makes no sense to anyone but them and the religious right, so if Kennedy votes with the liberals, then it will be struck down.

    However, they've also been known to carve out extremely narrow decisions that have almost no effect on anything except the specific case they are hearing, so no guarantee they won't try to do that as well.

    However, with DOMA also up for a constitutional test... if that gets struck down, it would presumably have a nationwide effect.

    I don't hold out that this challenge will be successful. Nor will the DOMA challenge.While Kennedy did work magic in Lawrence, I don't think he will work magic this time.

    What I'm interested in is when same-sex couples can resume getting married in California. After Judge Walker ruled that Prop 8 was essentially void, couples couldn't simply get married in the state right after.

    If the ninth circuit will not rehear the Prop 8 case, then can't we get a window of time where same-sex marriage licenses are legal again in California?

    On the federal level, I think we need some sort of big movie to come out that will influence people's minds in a positive way. Like "Milk 2" or something!

    Since the 9th circuit court stayed its order, same sex marriage cannot resume until the supreme court either declines to take up the case or it takes up the case and affirms the 9th circuit ruling
