    Does that Ohio High School not have a Young Democrats/Republican club then? What about a debate team?

    They have a pro-life club. Not allowed to be political my ass.

    Hell, my high school had CNN/Fox News (depending on the teacher) running the election coverage in 2004.

    Otherwise I really don't get how they could outlaw this.

    We had a Gay Straight Alliance at my high school...

    Also had rainbow stuffs, from GSA. We even had "National Coming Out Day" there.

    Bunches of stupid petty excuses and the fact that they had NO right to do that.

    Its up to the school to decide what is "disruptive behavior". People don't really understand that you don't have rights inside a school because your behavior directly effects the rest of the student body and the administration has to account for that as well. I disagree with this decision however, and hopefully if there are double standards at work they can be pointed out to undermine the administration's position.

    I gotta say, this double standard that they have a prolife club and pull a stunt is bull... *sigh* I'm kinda embarrassed to say I'm from Ohio right now...

    No, it is not entirely up to the school.

    You have reduced rights because of the doctrine of in loco parentis, but you don't surrender constitutional rights altogether. The Court has been messing with Tinker so that its scope is more limited, but I am not aware that it's been overturned yet. For example, Fraser which limits student "indecent" speech does not apply to this case because there is no overt sexualization going on. They are just saying that LGBT people should have equal rights, which is a political message, not a sexual one, so it probably won't withstand scrutiny. I think this should be litigated.

    Pretty sure they'll be singing a different tune when the ACLU gets involved. The ACLU lives and dies for cases just like this. They have a team set up to address this exact issue, because it happens so frequently across the US, if I'm not mistaken. The school has absolutely no legal precedence or constitutionally sound basis for what they're doing here and if they don't back off, they'll get stiffed hard with a lawsuit. Plenty of other schools with bonehead administrators can attest to that...

    Then I'd recommend talking to your local ACLU and document exactly what's happening. It's illegal to silence student speech the vast majority of the time on LGBT rights, and the ACLU has a good track record litigating these kinds of cases. You don't necessarily need to have them sue. Sometimes, a simple cease and desist letter (a litigation threat) can do the trick.
