Texas judge enforces ‘morality clause’ to split up lesbian couple – LGBTQ Nation

Um, wow, Texas. This is the kind of backward homophobic sleaze you elect as a judge?

How could a supposed guardian of justice possibly consider this an acceptable application of the law- splitting up a loving couple because the judge doesn't like their "lifestyle"? But I guess that's the Republican way...

    Morality clauses are unconstitutional.

You cannot use the bench to intercede into the privete life of the citizen because your tiny brain and tiny dick cant take the idea that the world does not conform to your ayn rand orgy of stupidity.

Erm... I'm pretty sure what the judge himself is doing is illegal.

Now this is the part where they move to a more liberal state, right?

Given the bitter custody battle I'm sure the mother is legal barred from moving the children out of state. This is horrifying.

That is absolutely disgusting but I'm not surprised. That area of Texas is just north of Dallas, and it's where people who have to work in Dallas live when they don't want to associate with pretty much anyone other than the same kind of person they are, so you end up with a bunch of right wing religious people in the same place.

Well it's definitely scary if this ends up being the final ruling left to stand, and they really have to split up and be forced to just live alone until the kids are grown up. Hopefully they can at least appeal the ruling.

I guess the lesson is not to live in areas dominated by backward bigots in the first place, you might get trapped by crazy shit like this.

The Judge needs to be debenched. I wonder what the texas process for that is.

Justice is suposed to be blind, and therefore, the judge does not have the right to use his religion to punish someone elses private, constitutionally protected choices.

Lawrence V. Texas was the nail in the coffin of this judges ruling, and that happened ten years ago. you cannot punish a person for being gay, because that breaks the law.

Someone has pictures of that judge gaying it up the butt in a bar bathroom. it is a given.

Let's keep in mind Texas is full of bigots, ignorance, and backwards laws and rulings. Corruption in the state is rampant, and there are ridiculous laws on the books (I believe sex toys either currently are, or recently were, completely illegal there.)

You have places like Dallas and Austin and a smattering of people in other places that are liberal and sensible and openminded... but you have a lot of fossils and ignorants on the bench that make ridiculous decisions like this one.

My guess is that the ACLU will get involved and this will get overturned.

Damn it Texas! Get your shit together!

Then again, this is a state where One must acknowledge a supreme being before being able to hold public office. So I'm not surprised that this dinosaur is allowed to be a judge.

As much I love my home state, this is sadly true. Sex toys are no longer illegal, since I believe 2010. I'm not certain if that was enforced before 2010, but alas, it was on the books. In my experience and from talking with others, as well as looking at voting maps and the like, the metropolitan centers of Texas, (Dallas, Austin, Houston, San Antonio, El Paso, Fort Worth and even from personal experience, Corpus Christi) are pretty LGBT accepting. Fort Worth is the last republican stronghold of the major cities, and I'm pretty sure even that is fading. Amarillo and Lubbock I won't vouch for, as I don't know for certain, and I'm guessing that they are probably not very friendly. Once you get outside of those major metropolitan areas, it's the wild west for the LGBT population who lives there. It's scary. I would never want to live in Texas outside of those areas.

Fortunately, I'm going to school smack in the middle of DFW, so I think i'm okay. I feel horrible for this woman and I hope someone with some clout goes to bat for her.

Also, in defense, most Texans I've met are really exceptionally friendly, cool people and they don't care if someone is gay or not.

I realize that's not true for ALL Texans, some are assholes.

Also, Texas is a place that is very friendly to people already in office, and most of these dinosaurs were elected a long long time ago, so they may not accurately represent the people anymore. Plus the churches have a lot of political power in Texas, not to mention money.

Are the cities in Texas really that much more progressive now? Other than Austin, I mean?

Austin was the only city to vote against the anti-gay constitutional amendment there in 2005. Travis County was actually the only county in the state of Texas to reject the amendment, with 40% voting in favor to 60% against.

Harris County (Houston) voted over 72% in favor. Dallas County voted over 66% in favor. Bexar County (San Antonio) voted 69% in favor. El Paso County voted 68% in favor.

The amendment passed statewide with over 76% support. Seems like rather a bleak environment for LGBTQ people.

It's certainly not as progressive as California or New York, but I'm damn proud of any progress my state has made.

    ---------- Post added 18th May 2013 at 12:28 PM ----------

And I'd say there's been a good deal of progress since 2005

I am no lawyer, how can one declare what constitutes as "moral", what kind of a clause is that?

Here's what's interesting. Even when you look at California, there are a bunch of large population centers where the liberal-minded people reside, but probably 70% of the state (by geography) votes conservatively.

I think the same may be true for Texas; you have a sprinkling of liberal people throughout (based on my experiences visiting various cities there) and a whole lot of conservatives. But I do think the biggest population centers are certainly more progressive than they were 10 or 15 years ago.

That said... it's still pretty backwards overall.

Missouri is also pretty conservative, but I live really close to Kansas City, so my area is about 50/50 on the political scales. Which is funny especially because my best friend is a rather unknowingly intense Republican.

She won't take Spanish because it is "the language of the immigrants." She can be remarkably silly and cruel at times.
