Ugh. It reminds me of all the other stupid zero tolerance policies.

This is just utterly ridiculous. Is it appropriate for police to show up and maybe question him? Sure. Although it was clearly sarcastic - if in bad taste - on the extremist end of things showing up to question him could be argued to be appropriate. However, once he's been determined to NOT be a threat and to have been speaking with sarcasm then it's time to move on to more legitimate issues.

...not press charges and threaten to throw him in jail for eight years.

Hopefully a prosecutor throws out the case, and the kid and his family sue the fuck out of the police department for defamation of character and assault against his right to Free Speech. This is just such a waste of public resources and time that the Chief of Police there should be fired for criminal stupidity and mismanagement.

^Find someone in that Texas community doing it, and call the police and see how they respond. :stuck_out_tongue_closed_eyes:

This sort of thing (and zero tolerance rules) are what happens when you have people who have no capacity to understand nuance or make reasonable judgment calls making laws or policies.

While anyone who's ever been on the Internet should be able to read the bleeding sarcasm in that post, why the hell would you even joke about shooting up a school and eating hearts?

There are some things that are exempt from being used in sarcastic comments, and I think that topic falls under that category.

I suppose you could say both parties are in the wrong. It's just stupid all around, tbh.

He shouldn't have made the comment to begin with, but...

HELLO?! ANYBODY LISTENING? Have you ever heard of the FIRST AMENDMENT?!

Perhaps you haven't. I'll be courteous and link it below:
    U.S. Constitution - Amendment 1 - The U.S. Constitution Online - USConstitution.net

Here's a little bit more on it:
First Amendment to the United States Constitution - Wikipedia, the free encyclopedia

And here it is in the Government archives of the Bill of Rights:
    Bill of Rights Transcript Text

There. Now you know the decision is unconstitutional.

Oh, wait.. You're Texas. You have your own rules.

    I'm sorry.

I don't think a shooting something to joke about, but no one should be arrested for a stupid joke.

If people are going to be put in prison for being a smart ass, then I better watch out because I'm on my way to death row. :stuck_out_tongue_closed_eyes:

He shouldn't even be in jail in the first place. His arrest was against the first amendment. This follows nothing in the Free Speech clause that isn't protected.

But nooo, Texas has to go against the constitution, yet again.:bang:

I vote on Facebook and Twitter
    #sarcasm
This would stop the stupidity of jailing people for jokes

"What is happening in this country! Westbro Baptist Church can say and do pretty much whatever they want and a kid (yes 18 is still a kid to me) makes a sarcastic comment and he is in jail. I am sick as to what is happening to the former great USA."
