You hope they win? They're obviously going to win against the hotel. Hotels do have a right to refuse guests to stay at their hotel under certain circumstances. However, sexual orientation is not something you can refuse.

Considering how US courts have been ruling recently concerning equal rights, I wont be in the least bit surprised to see this lawsuit become successful. Hell, it is flat out obvious they were discriminated against. A business owner, as far as I know, is like an employer, they cant ask you your orientation & then base any decision around the answer. Obviously equality & discrimination laws will vary by state, but even some conservative jurists are ruling in favour of equal rights for LGBT people.

In this case, I'm talking specifically about the state of Hawaii in which the hotel is located in which it is illegal. So you're not wrong in stating that only a couple of states have a law against this type of discrimination.

I wonder what the standard is for deciding who is and isn't in a protected class at the federal level. LGBTs have just as long, varied and ongoing a history of persecution as disabled, religious and ethnic groups.

I mean, if I went to the US and were assaulted for being British, which is extremely unlikely, it would be considered a hate crime, because nationality has protected status. Even though to my knowledge British people have next to zero history of being persecuted. But if I were assaulted because someone thought I were a lesbian, which is something that does happen to people, it wouldn't be a hate crime?

Maybe the problem is historical ignorance?
